User Contributions

Governing Law
The Websites are created and controlled by New Belgium and shall be governed by the laws of the State of Colorado. As such, any claim relating to the Websites, the services provided through the Websites, or to these Terms of Use shall be governed by the substantive laws of the State of Colorado, without giving effect to any principles of conflicts of law.
Acknowledgement and Changes
These Terms of Use represent the entire understanding between you and New Belgium regarding your relationship with New Belgium and the Websites and supersedes any prior statements or representations. In the event that any provision of these Terms of Use, or portion thereof, is determined to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to give effect the intent of the Terms of Use and the remainder of the Terms of Use shall continue in full force and effect. New Belgium Brewing Company, Inc., and Bell’s Brewery (a division of New Belgium Brewing Company, Inc.) (together “New Belgium” or “we” or “us”) respect your privacy and are committed to protecting it through our compliance with this policy.

Information We Collect About You and How We Collect It
We collect several types of information from and about users of our Websites, including information:

We do not collect personal information automatically, but we may tie this information to personal information about you that we collect from other sources, or you provide to us.

Third Party Use of Cookies and Other Tracking Technologies
Some content on our Websites, including but not limited so some delivery services, are served by third parties. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our Websites. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.
We do not control these third parties’ tracking technologies or how they may be used. Information We Collect through Mobile Applications
You may be asked to provide personal information to participate in our promotions, including text to win promotions entered by sending a keyword to a phone number or SMS (Short Message Service) short. You may also subscribe to New Belgium mobile alerts to receive automated product updates via text messages. By subscribing to New Belgium mobile alerts, you consent/opt-in to receive automated, periodic product updates via text messages. Consent is not a requirement for product purchases, product service experiences, or other transactions. There is no fee imposed by New Belgium to receive text messages; however, message and data rates may apply to you. Please check with your mobile service provider to determine if message and data rates apply to you. Charges are billed and payable to your mobile service provider or deducted from your prepaid account based on your mobile plan.
Data obtained from you in connection with an SMS service may include your mobile phone number, your carrier’s name, and the date, time, and content of your messages. We may use this information to contact you and provide the services you request from us. Alerts sent via SMS may not be delivered if the mobile phone is not in range of a transmission site, or if sufficient network capacity is not available at a particular time. Even within a coverage area, factors beyond the control of the wireless operator may interfere with message delivery, including your equipment, terrain, proximity to buildings, foliage, and weather. Wireless operators do not guarantee message delivery and will not be held liable for delayed or undelivered messages. We will not be liable for any delays in the receipt of any SMS message as delivery is subject to effective transmission from your network operator.

How We Use Your Information
We use information that we collect about you or that you provide to us, including any personal information:

We may use the information we have collected from you to enable us to display advertisements to our advertisers’ target audiences. All above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third party.
Disclosure of Your Information
We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.
We may disclose personal information that we collect, or you provide as described in this privacy policy:
- To our subsidiaries and affiliates.

Choices About How We Use and Disclose Your Information
We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:
- Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of the Websites may then be inaccessible or not function properly.
- Promotional Offers from New Belgium. If you do not wish to have your email address or contact information used by us to promote our own or third parties’ products or services, please adjust your user preferences in your account profile by checking or unchecking the relevant boxes or by sending us an email stating your request to nbb@newbelgium.com. If we have sent you a promotional email or text, you may send us a return email asking to be omitted from future email distributions or text STOP to the number you received a text message from. This opt-out does not apply to information provided to us as a result of a product purchase, product service experience, or other transaction.
We do not control third parties' collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative ("NAI") at NAI’s website.

Accessing and Correcting Your Information
You can review and change your personal information by logging into the Websites and visiting your account profile page.
You may also send us an email at nbb@newbelgium.com to request access to, correct, or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
If you delete your User Contributions from the Websites, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other Website users. Proper access and use of information provided on the Websites, including User Contributions, is governed by our Terms of Use.

Your State Privacy Rights

California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Montana, Oregon, Tennessee, Texas, Utah, and Virginia provide (now or in the future) their state residents with rights to:
- Confirm whether we process their personal information.
- Access and delete certain personal information.
- Correct inaccuracies in their personal information, taking into account the information’s nature processing purpose (excluding Iowa and Utah).
- Data portability.
- Opt-out of personal data processing for:
- Targeted advertising (excluding Iowa);
- Sales; or
- Profiling in furtherance of decisions that produce legal or similarly significant effects (excluding Iowa and Utah)
- Either limit (opt-out of) or require consent to process sensitive personal data.

Nevada provides its residents with a limited right to opt-out of certain personal information sales. However, please know we do not currently sell data triggering that state’s opt-out requirements.
Data Security
We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our secure servers behind firewalls. Any payment transactions and user-submitted profile information will be encrypted.
The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Websites, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. The information you share in any public areas may be viewed by any user of the Websites.
Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Websites.
